见义勇为者合法权益的法律保障与补偿机制

对见义勇为者合法权益的保障，是一种道德上的正义，是维护道德秩序的必然性要求。在道德失范的情况下，法律的介入是必要的。不同的部门法为见义勇为者提供了不同的保障机制，但却不是都有效的。将诬陷“好人”入刑的实证法学观点不但是无效的，还会引发新的社会问题；民法所提供的私力救济也不能全面覆盖见义勇为者合法权益的各个方面。作为社会救助义务的应然的承担着，政府不但有义务，而且也有能力对见义勇为者进行补偿。

To protect the legitimate rights and interests of heroism activist,is a kind of moral justice,and is inevitable request to maintain the moral order.In the situation of moral anomie,legal intervention is necessary.Different department laws have provided different security mechanisms,which are still not effective.The views of leading the action of framing the "good people" into the criminal law is ineffective and will cause new social problems;private relief provided by civil law cannot cover the whole aspect of the legitimate rights and interests of heroism activist.The government,as the social assistance obligation,should undertake,not only has the obligation,but also has the ability to compensate the heroism activist.
