民事执行检察监督工作机制研究

2012年修改后的《民事诉讼法》确立了我国的民事执行检察监督制度，该制度的建立有利于制约审判权和实现司法公正，有利于依法治国方略的实现。然而，修改后的《民事诉讼法》对民事执行检察监督的范围、原则、方式、程序等并没有作出细化和具体规定。针对司法实践中民事执行检察监督工作存在的主要问题，提出了完善民事执行检察监督工作机制的对策建议。

Study on Mechanism of Civil Execution Procuratorial Supervision

The revised Civil Procedure Law established the civil execution procuratorial supervision system in 2012.The establishment of the system is conducive to restrict adjudicative and realize judi-cial justice and the rule of law strategy implementation.However,the new civil procedure law did not make detailed and specific provisions for the procuratorial supervision scope,principle,method and procedure.For the judicial practice in the main problems of civil execution procuratorial supervision work,we put forward the countermeasures and suggestions of improving the civil execution procurato-rial supervision mechanism.
