| 摘 要： | 中国的知识产权刑法保护制度有其特点,而这种特点与中国的政治社会经济状况和刑法制度本身是密切联系的。刑法重罪重刑的特点决定了刑法入罪门槛的高度,因此若要讨论降低侵犯著作权犯罪入罪门槛的问题,从罪刑均衡和法律内在和谐一致的角度,就必然要考虑该类犯罪的刑罚轻缓以及其他犯罪门槛相应降低等问题。

| Abstract: | China's criminal law system for protecting IP rights bears its own characteristics, which are closely related to China's political, economic and social circumstances as well as to its criminal law system. The characteristics of "heavy crimes, heavy punishment",consequently, lead to a relatively high criminal threshold in our criminal law. As a result, if lowering the criminal threshold of crimes against copyright is to be examined, we have to consider the leniency towards this type of crime and lowering the criminal threshold of other related crimes. |
