| 摘 要： | 行政赔偿是国家赔偿的主要组成部分，行政赔偿程序的完备与否直接关系到受害人能否及时获致行政赔偿。海峡两岸对此有不同的制度安排和程序设置，本文分别就处理前置、赔偿诉讼与追偿阶段展开比较分析，期望有利于大陆国家赔偿法的完善与实施。

| Abstract: | One of the major component parts of state compensation is administrative compensation, and the completeness of its procedures directly affects the availability of administrative compensation for the aggrieved patry. The operation sys- tem and procedure establishment for that differ on both sides of Taiwan Straits. In an attempt to contribute to the perfec- tion and implementation of the state Compensation Act in the mainland of China, a comparative study is conducted by the author on the issues such as preconditioning, compensation proceedings and claiming process. |
