| Abstract: | Jury institution is a democratic system of jurisdiction, in which the jurors and judges are both the executors. The power relationship between them reaches balance by way of micro_distribution of jurisdiction. This thesis, based on the restrictive theory of the essential factors in power, analyses the restrictive relationships between the jurors and judges and the reasons causing the shortcomings in China's jury institution and tries to reconstruct the power relationships and the operation sequences. |
