反思新道统法哲学的话语逻辑

新道统法哲学是针对“中国法学向何处去”之间而建构起来的一种法哲学。新道统法哲学通过中西之争和古今之辩而形成和发展起来，所以有必要对中西之争和古今之辩的话语逻辑进行分析。经研究发现，由于两者内含的辨析逻辑层次不一致而导致内在的紧张，需要对其中的逻辑进行合理解释和调整。由于新道统法哲学对知识论的逻辑没有交待清楚而导致诸多错误理解，因此需要对知识构建论的内在逻辑进行调整，以消除误解。
