| 摘 要： | 单位犯罪历来为刑法学界所关注。随着新刑法典的颁布和实施,有关单位犯罪的热点问题发生了转移,其中的争议之一就是单位犯罪应在何种范围内成立。作为分析问题的两个不同视角,相关的领域界定和主观形态界定就成为不可或缺的话题。
