论分权制衡原则对中国法治的影响

美国宪法的创制与实施是建立在分权制衡原则之上的,这一原则在西方有着源远流长的理论传统,在实践上对于权力的约束亦有现实意义,对美国社会的稳定与持续发展更是起到了不可忽视的作用。在我国进行政治体制改革的今天,我们更应该在全面理解分权制衡原则的基础之上,借鉴其在美国法治实践中的得失,推进我国法治进程。

On the Principle of Separation of Powers and Checks and Balances and its Influence to Chinese Rule of Law

The enactment and enforcement of the U. S. constitution is based on the principle of separation of powers and checks and balances of long standing and well established in the western countries. The principle is of great importance to constrain the powers and of great role to maintain the stability and development of America. Nowadays, China is in the procedure of political structural reforms. We should understand the principle and use the experience of America for reference and carry forward the Chinese rule of law.
