| 摘 要： | TRIPS协议关于著作权的刑法保护与我国刑法典的规定在犯罪主观要件、客观要件、法定刑、对侵权复制品的处理等方面存在较大差别,我国在完善侵犯著作权犯罪立法时应参考借鉴TRIPS协议的有关规定。

| Abstract: | There exists a considerable content gap between the TRIPs Agreement and China's criminal law on crimes against copyright, in terms of criminal subjective elements, objective elements, statutory sentences and the handling of infringing duplicates. We should refer to the related stipulations of the TRIPs Agreement when improving our criminal law on crimes against copyright. |
