摘    要:设立物业公司对业主的安全保障义务,符合现代民商法的基本精神和世界立法思潮。物业公司违反安全保障义务应承担的责任形式主要有直接责任和补充责任两种,对其应采取过错责任的归责原则。

Abstract:The terms on the security obligations of the real-property management company to its proprietors conform to the essence of modern civil and commercial laws as well as to the common practice of legislation in the world.There are two forms of liability on the part of the real-property management company for nonperformance of its obligations,i.e.,direct liability and additional liability,to which the fault-imputing principle should be applied.
