简论中国古代清官的法律人格

清官是中国古代重要的法律人,具有明显的法律人格特征。古代清官法律人格的外在表现既体现在司法活动的断案上,又体现在他们与人民群众的关系上。古代清官法律人格的内在精神主要体现在其道德品质、知识结构和价值追求上。清官的法律人格是中国特定的文化塑造出来的,这种人格在一定程度上抑制了社会的矛盾和冲突,维护了社会的稳定和发展。但是,清官框扶正义的社会效果非常有限,而且麻痹了平民百姓的抗争行为,对中国的法治建设造成了消极影响。

Incorrupt judges are important templar wit h distinct characteristic on their legal personality in ancient China.The extrinsic behavior of their characteristic consisted in their trial course and their relations with people.The intrinsic direction in spirit consisted in their moral character,knowledge and value orientation.The incorrupt Judges' legal personality of ancient China that were molded by Chinese culture,could restrain social conflict,and safeguard the stabilitation and development of society.But,the effect that incorrupt judges did to realize the justice was very slight,and they paralyzes the resistance,which brings negative effect to the nomocracy construction of China.
