小产权房的合理性分析

摘    要:由于城镇商品房房价的不断攀升和城乡土地二元制政策等多种原因催生了所谓“小产权房”问题。“小产权房”的出现和交易量的扩大其实具有法理基础和一定的现实合理性、不应简单处理、一律叫停。应当加快农村集体用地使用权合理流转的立法。进一步完善城乡土地管理法律制度,才能正确妥善解决好“小产权房”问题。
