| 摘 要： | "促进型"经济法是以促进或鼓励为目的的经济法规范的总称,它是经济法规范的重要组成部分。我国传统经济法以"限禁型"规范为主,在面对日趋复杂的经济问题时,"限禁型"经济法可能会遭遇不同程度的执法困境,并面临难以解决的"信息悖论"问题。与此相比,"促进型"经济法不仅能够有效克服"限禁型"经济法的局限性,在特定领域或对特定问题解决上也比传统的"限禁型"经济法更具优势。我国未来经济法的发展方向,既要保留必要的"限禁型"规范,也应引入适量的"促进型"规范,二者应当相互配合、共同作用。

| Abstract: | Traditional economic law in China is mainly governed by the restriction or prohibition-oriented legal norms. These legal norms may experience varying degrees of enforcement difficulties and inevitably encounter the information paradox. In contrast,the promotion-oriented economic law can overcome those limitations and is comparatively more effective in certain aspects.
