恶意支付大量小面额货币的法律规制

司法实践中恶意支付大量小面额货币的现象层出不穷，反映了我国相关法律在实际应用中与立法初衷的分歧。对于遭遇恶意支付大量小面额货币行为的救济，成为迫在眉睫的问题。鉴于恶意支付大量小面额货币行为的不同类型，文章分别从私法与公法角度出发，分析恶意支付大量小面额货币行为的法律形态，确定在私法与公法上的救济途径。同时借鉴域外立法，完善相关救济途径，更好地避免此类行为的发生。 

Legal Regulation of Malicious Payment with Large Amounts of Coins

The phenomenon of malicious payment with a large number of coins in judicial practice is emerging, which reflects the differences between the practical application of relevant laws in China and the original intention of legislation. The relief of malicious payment with a large number of coins has become an urgent problem. In view of different types of malicious payment with large amounts of coins, this paper analyzes the legal form of malicious payment with large amounts of coins from the perspective of private law and public law, and determines the relief ways in private law and public law. Meanwhile, learning from extraterritorial legislation and improving relevant relief ways can better avoid the occurrence of such acts.
