犯罪本质的“虚无”——基于黑格尔自由意志的思辨维度

黑格尔认为犯罪本质上是虚无的，要深层次去揭示犯罪本质的虚无性，就必须演绎整个思辨逻辑的全过程再回到起点，才能达到对这一论题的深刻把握。自由意志是黑格尔整个法哲学体系的核心，从自由意志到抽象法、从抽象法到不法、从不法到犯罪、最后从犯罪到自由意志的逻辑回归，犯罪本质的虚无性得到了深层次的揭示，其虚无性就在于扬弃了作为法的定在，但却不可能扬弃作为绝对的东西的法本身，对于法来说，犯罪就具有虚无性，而这一切最终极的源头就在于自由意志的虚无性，这也是犯罪本质虚无性的根本之所在。
