论城市化与法治化的融合与互嵌——兼及律师参与城市征迁的晋江经验

城市化与法治化本应形成良性互动关系,而当前我国城市化过程却出现了以违背法治的方式来推进城市化的问题,这无疑是背离世界城市化发展客观规律的,也与城市化目标相去甚远。如何实现城市化与法治化之间的融合和互嵌已经成为我国目前统筹城乡一体化的时代课题。为突破城市化面临的法治困境,晋江市在征迁活动中创新性地引入律师法律服务机制,推行征迁项目管理的法治化,切实地保障了被征迁人的合法权益,实现了和谐拆迁的共赢局面。

On the Integration between Urbanization and the Rule of Law -Also on participation of lawyer in levy and demolition in JinJiang

There should exist a positively interactive relationship between urbanization and the rule of law,but in China,the way of urbanization goes against the demands of the rule of law,which is far from the goal of urbanization.How to achieve a harmonious integration between them becomes an imporant issue.In order to break through the dilemma arising in the process of the urbanization,a mechanism of service offered by lawyers is introducted creatively by the Jinjiang government in targeting at controlling the management of relocation by rule of law;this measure realistically safeguards the rights of the people concerned and help achieve a win-win situation in relocation.
