商品房预售资金监管制度的国际比较研究

摘    要:商品房预售最大的风险莫过于开发商滥用资金、抽逃资金,导致楼盘烂尾,最终使购房者利益得不到保障。因此,国际上很多国家都有一套非常严格的资金监管制度。我国1994年开始实施预售制度但直到2005年,各地才纷纷制定有关的《商品房预售资金管理制度》,而真正引起重视的也只是在最近一两年。文章旨在通过对美国、日本、新加坡以及我国香港地区的预售资金监管制度进行对比分析,结合我国大陆房地产预售制度的窘迫现状,认为目前还不宜取消预售,而是应该通过加强商品房预售资金监管力度,进一步完善房屋预售制度。

Abstract:The biggest risk of the commercial housing presale lies in that the buildings are not completed because of the advance payments being abused and stolen by the real estate developers,and the consequence is that the benefit of the homebuyers can′t be guaranteed.Therefore,many countries in the world have a very strict capital supervision system.The presale system was put into effect in 1994 in China,but the local governments did not start formulating the concerned.Commercial Housing Presale Capital Supervision System until 2005,and they attached importance to the issue in recent years.This paper makes a comparison of the capital supervision systems in the United States,Japan,Singapore,only and Hong Kong with the present situation of the commercial housing presale in China′s mainland,and then suggests that the commercial housing presale system should not be canceled but to be perfected by strengthening the fund supervision at the present.
