A Functional Analysis of the Jurisdiction Interaction between preliminary ruling Adjudication and Direct Action of European Court

The issue of the jurisdiction of the European Court of Justice(ECJ) is of great importance in the Commu-nity judicial system, which has attracted great attention of the scholars in the field of the Community Law. The au-thor has made a comprehensive study into the procedure of preliminary ruling of ECJ under Article 234{177} EEC with a contract with the jurisdiction of direct actions under Article 226{169} and Article 230{ 173} EEC. There exist an overlap and the conflicts among the above jurisdictions, and it is the Court thai has solved this issue through its judicial practice. The author seeks to make it known that the establishment and the development of the Community' s judicial system is almost impossible without the performance of the jurisdiction of the ECJ under Article 234{177} EEC.
