城市污水处理厂的法律属性分析——从环境法的角度

城市污水处理厂是污染物排放主体。在污水处理企业的市场化转型过程中,城市污水处理厂由原来的公益性质企业改制为按照公司治理模式运营的企业。目前,各级环境保护行政主管部门将城市污水处理厂视为排污企业并纳入相应的监督和管理体系之中。从环境法的角度分析,城市污水处理厂不应被定性为普通的"排污企业",公益性质是这类企业的根本性质。应对城市污水处理厂的法律属性进行重新认识,并建立和实行配套的监督和管理制度。

On Legal Properties of City Sewage Treatment Works:An Environmental Law Perspective

As the mainstay of pollutant discharge,the city sewage treatment works,an originally public enterprise,has been transformed by the marketization of sewage disposal operation into a corporate one.Currently,environmental protection administrations at all levels treat it as a pollutant-discharging enterprise and put it under consequent supervision and administration.From the perspective of environmental legislation,however,the sewage treatment works should not be designated a polluter in the common sense since this type of enterprise is basically public.We shall reevaluate its legal property and build and implement the supporting supervision and administration system.
