| 摘 要： | 高校对学生进行处分是高校管理的重要内容,与学生的合法权益密切相关。但我国法律对高校处分程序并没有作出规定,有必要建立处分听证制度,通过立法要求高校在行使处分权时应当听取学生的陈述和申辩,在此基础上决定对学生是否给予处分;对于拟作出留校察看、勒令退学、开除学籍等影响学生受教育权的重大处分前,应当举行听证会,根据听证会记录作出处分,以保证高校正确行使处分权,防止滥用。

| Abstract: | An important content of college administration is punishing students,which is closely related to the students' legitimeate right.However,China's law doesn't have any regulation about the punishment procedure.For this reason,it is very essential to formulate a hearing system of punishment,that is to say,using legislation to require higher education institution that when exercising the power of punishment they should hear the explanation and de- fends of the students,on the basis of which they decide whether to punish the students.If the students are supposed to be punished severely by remaining at school and examining,ordering to leave school,expelling form school,which will have great influence on their educational right,the institutions should hold hearing and make decisions exercise the punishment and not abuse it. |
