| 摘 要： | 为防止自助被滥用作强国对弱国任意施加强制的借口，国际法必须对自助合法的条件加以限定。先前国际不法行为的发生是自助措施获得合法性的前提。自助应以获得赔偿、免受进一步损害以及促进争端解决为目标。自助不得以惩罚为目的。自助必须遵循必要和相称原则，并应同时遵守国际法规范所设定的其它限制。
