关于不定期刑的若干思考

自由刑的量刑模式有两种:定期刑和不定期刑。美国经历了从定期刑到不定期刑再到定期刑的司法改革历程。我国刑法中仅规定了定期刑,不定期刑不仅在立法中处于空白地位,在理论界也鲜有人论及。定期刑与不定期刑孰优孰劣?笔者认为,我国的刑罚改革要力求有所突破和成效,对不定期刑的重新正确认识和借鉴,是非常有益和必要的。笔者期望从它们的传承中领悟到未来的自由刑裁量模式。

A View of Indeterminate Penalty

Liberty penalty has two forms,determinate and indeterminate penalties.American judiciary reform undergoes from determinate to indeterminate and then to determinate penalty again.But in Chinese judiciary system only determinate penalty remains,indeterminate penalty is still systematically vacant nor to be explored in theory.Which is better of the two penalties?
