| 摘 要： | 非决策决定使社会公正在政策议程确定时受到致命威胁,一个制度内现存的权力分配常常是导致社会公正缺失的主要原因,公正缺失的残酷可能内含于法律政策体系之中.因此,有必要回到矫正公正的立场上对公共性进行追问,并在此基础上建构和启动政策协商的机制.

| Abstract: | Non-decision-making makes social justice fatally threatened when policy agenda is determined.The existing distribution of power in a system is likely to be the main reason leading to the lack of social justice. The cruelty of just absence is inside the legal and policy system. Therefore,it is necessary to return to the corrective justice position to make the publicity clear,and on the basis of that to construct and start policy deliberation mechanism. |
