论道地药材的地理标志保护

道地药材与我国特有的地理文化背景及中医药理论有关,是我国独有的提法.因其有效成分高和临床疗效显著,倍受医药界和药材市场的青睐.道地药材的市场需求巨大,但是在产销等环节存在着诸多问题,影响了道地药材良好的口碑和其经济价值的实现.地理标志与道地药材在内容的自然属性和人文属性、主体的集体性上有着明显的契合,因此可以通过地理标志制度来保护道地药材所具有的无形价值.现有三种地理标志制度体系对道地药材进行保护,但三者相互之间在适用上几乎没有协调合作,在应用和执法过程中也存在问题,甚至是冲突,因此急需对三种制度体系进行协调整合.

The Research on Protection of Geographical Indication of Chinese Geo-herbalism

Chinese Geo-herbalism which is in connection with our geographical culture and the theory of traditional Chinese medicine,is a particular concept in the world.Because of its higher effective element and good clinic effectiveness,Chinese Geo-herbalism is favored by consumers and the market.Although its requirement is large,there are a lot of problems in the production and marketing,which has affected its public praise and economic value.There is harmony between Geographical Indication and Chinese Geo-herbalism on the content and main body,so Chinese Geo-herbalism can be protected by Geographical Indication.However,there are three Geographical Indication law systems to protect Chinese Geo-herbalism and they have no coordination between each other.Thus,problems and even conflicts have occurred in the application of law.Therefore,these three Geographical Indication law systems should be coordinated.
