| 摘 要： | 汉赋以“通过文学的法律”和“作为法律的文学”的形式,对汉代的立法、司法、执法通过铺陈进行了充分的表现.汉赋中表现的法律精神和法律理想主要有:支持天罚神断、天人合一的思想;借助鬼神追求绝对公平的愿望;提倡德主刑辅的精神等.赋作家在作品中建构出盛世图景,表达其政治理想,推动了礼法制度的改善和进步.

| Abstract: | This paper analyzes legislation,justice and law enforcement from two aspects: law through literature and literature as law.Han Fu embodies the spirit and the idea of law.It is showed by the following points: the theory that man is an integral part of nature;the wishes to pursue absolute justice with the aid of supernatural beings;and the spirit of ruling of morality with penalty as assistance.Writers express their feelings in literature work,and in return,their works will create a feedback loop to the society. |
