| 摘 要： | 《侵权责任法》的颁布在客观上引起了中国侵权法性质的改变。虽然造成这一结果的成因是十分复杂的,但最深层的根源应当是中国法律文化内部结构的不稳定状态。在探寻这种不稳定结构产生原因的过程中,发现侵权法内部所发生的变革是立法者要求中国法律文化结构回归稳定状态的文化自觉,而相应的立法措施则是相关制度本土化改革的具体表现。

| Abstract: | The system of tort law was changed as the reason of Tort Liability Law.Though the origin of this fact is very complicated,the most underlying reason is that the internal structure of legal culture in our country is unstable.On the procession of exploring the causation for this unstable structure,such revolution of tort law is caused by the needs that this structure is return to a state of equilibrium,and the related legislative measures is the specific performance of the reform of localization. |
