“犯罪有益论”之“功能观”批判

国内刑法学界近年来出现了"犯罪有益论"、"相对主义犯罪观"学说,这一学说认为犯罪对于社会发展具有正面的促进作用,并且由于其观点的"新颖性"而受到诸多年轻学子的追捧,形成了不正确的理论误导。而其支持性理论之一在于:犯罪有着应当加以肯定的促进社会发展和制度完善的积极功能或者正面功能。因此,对于"犯罪有益论"者的"功能观"加以分析和批判,具有现实意义。

A Critique through the View of Function on the Thesis that Committing a Crime is Beneficial

In recent years, the thesis that committing a crime is beneficial and the view of criminal relativism is accurring in the domestic field of science of criminal law .These theories suggest that the crime can foster social progress. By reason of novelty of these theories, many young scholars come to support them. And it come to be a misleading situation. One of the theory in the point is the crime have a positive function of fosterring social progress and improving the system of society. So, the critique and the analysis on these theories is meaningful.
