民族习惯与法治目标

多民族的中国选择法治已是必然趋势。那么,作为法律渊源之一的习惯以及民族习惯,将如何迎接法治的选择或融合、其融合有无可能性,这是建构法治国必须考虑的问题。本文试图通过对民族习惯概念、特征及部分现象的解读,将其作为少数民族族民的事实上的行为规范予以阐析,探寻其与法治融合的切入点,并提出二者对接时应充分予以考虑的因素,完成二者的真正融合。
