| 摘 要： | 大陆法系国家卧底侦查实施主体表现出较强的统一性特点。英美法系国家卧底侦查实施主体则表现出明显的分散性与多样性特点。这与其立法模式与执法机构体制有着很大的关系。我国作为成文法系国家,执法机构具有统一性特点,宜采取综合式立法模式,以原则性规定为基础,结合列举说明的方式规定卧底侦查实施主体范围,同时在既有执法体制与现有法律基础之上构建体系性的卧底侦查实施主体,并规范卧底侦查具体实施者。

| Abstract: | The body of implementation about undercover investigation of civil law countries shows strong features of unity.The body of implementation about undercover investigation of common law countries shows significant characteristics of dispersion and diversity.It is related to the legislative model and their system of law enforcement agencies.China is a statute country.The enforcement agencies have the characteristics of unity.We should adopt comprehensive legislative model.We can determine the scope of the body of implementation on the provisions in principle and by listing type.At the same time,we can build systemic body of enforcement for undercover investigation on the basis of the existing law and enforcement system by regulating the specific perpetrators of undercover investigation. |
