| 摘 要： | 军人违反职责罪是十大类犯罪中最为独特的一大类 ,现行刑法典不仅明确了该类罪的法定概念、构成要件 ,而且设立了独具特色的处罚原则。把握好这一点 ,对于加深对法律条文的认识和理解 ,指导司法审判实践工作 ,都具有很强的现实意义
