论法治国家目标与社会保障法制化

社会保障是与市场经济伴生的一项制度 ,它是市场经济国家为解决“市场失灵”、达成均富社会所采取的途径和做法。社会保障制度旨在保障公民的生存权、实现社会公平和社会进步 ,这一点与法治国家社会正义的目标是一致的。而社会保障制度的确立和实施 ,必须借助于法治国家之下的法律制度化。惟有社会保障法制化 ,才能使社会保障制度有效地运行。

The Objectives of a Legal State and Institutionalization of Social Security

As a system that accompanies market economy, social security is an approach adopted by a market economy nation to solve"market ineffectiveness"and achieve average prosperity of the society. Social security system aims at ensuring right of existence of the citizens, achieving social equality and social progress, which is identical with the objective of social justice of a legal state. The establishment and implementation of the social security system, however, must seek help from the legal institutionalization in the country ruled by law. Only institutionalization of social security can ensure the effective implementation of the system.
