| 摘 要： | 破产法中自愿破产原则不仅标志司法机关无权主动判定债务人破产,而且债务人由于其具有的信息优势处于申请破产的最佳位置,因此破产制度构建中应当贯彻自愿破产原则.自愿破产制度设计往往决定着破产程序的目的能否实现和公司重整能否成功.我国破产法应当贯彻统一自愿破产原则,并通过现行破产法中的自愿破产制度进行反思和重构,使破产法制度成为统一的刚柔并济的有机整体.
