| 摘 要： | 在讨论我国公立高等学校与学生的法律关系基础上，对公立高等学校图书馆与学生读者之间适用法律关系进行了分析，认为公立高等学校图书馆是学校内部的职能部门，不具备独立的法人资格，其与学生读者之间的法律关系是学校与学生之间法律关系的具体体现，并表现出双重法律属性，即不同语境下的内部行政法律关系和民事法律关系。
