| 摘 要： | 情事变更原则实际上赋予法官根据公平原则否定合同效力的自由裁量权,司法实践中对该原则存在误解。充分全面认识情事变更原则必须从情事变更的事实和道义分析理论着手,从价值层面探讨情事变更原则的理论依据。

| Abstract: | Case change principle entitles the judge to denying the free jurisdiction of contract force on the basis of fairness principle in practice, but there are misunderstandings in legal practices. Therefore, it is necessary to start from the theory of case change and theoretical morality analysis to fully realize the reasons for case change. |
