论法律保留原则在保障公民财产权中的应用

尽管公民财产权受宪法和法律的保护,但是由于行政权的不断扩张和现有法律制度的缺憾,致使公民私人财产受到国家公权力的过度限制却找不到有效的救济途径,因此,加强立法、明确基本权利的法律保留原则、限制行政权力的扩张成了当务之急。随着人大监督法的出台,在权力制约方面应当发挥各级人大常委会的积极作用,使得对公民财产权的保障符合现实的需求,也为权力监督提供一个切实可行的途径,进一步推进社会主义民主法治建设。

Application of Principle of legal Reservation to the Security of Citizen''''s Property Right

Despite the fact that the citizen's property right is protected by the constitution and law,the citizen's private property right,restricted excessively by the state public power,cannot find effective remedy channels owing to the increasing expansion of administrative power and the drawbacks of the current law system.Therefore,it is an urgent task to strengthen legislation,clarify the principle of legal reservation as basic right and limit the expansion of administrative right.With the launch of the NPC's supervision law,the active roles played by NPC of all levels should be brought into full play in terms of right restraint so that the security of the citizen's property rights matches the demands,renders an effective channel for the supervision of rights,further optimize the construction of the socialism democratic legal administration
