| 摘 要： | 精神损害赔偿对于保护公民的人格权至关重要 ,然而就我国法律的现行规定来看 ,不仅精神损害赔偿的范围不甚周延 ,而且存在归责原则不明晰 ,赔偿义务主体及相应的损害赔偿方法不甚科学等问题 ,这一切都在不同程度上影响了受害人及其家属的权益 ,与法律保护人格利益的司法目标相去甚远。因此对现行法律进行完善是必要的 ,应建立真正意义上的精神损害赔偿制度。

| Abstract: | The rule of spiritual damage compensation is essential in protecting human dignity of citizens. However ,according to the present laws and decrees in effect, there are several problems to be solved. For instance, the scope of spiritual damage compensation is not all-encompassing, and the jurisdiction of the regulations is not distinct, and the subject of compensation duty and its related measures are not scientific. The problems mentioned above have affected the benefits of victims and their families. The current system in force has a long way to go in reaching our judicial goal. Consequently, it is quite necessary to improve the present laws and establish genuine compensating rule of spiritual damage. |
