| 摘 要： | 法学是不是一门科学的争论,实际上与科学本身的定位密切相关。作者分析了法学作为科学的4种存在形态,在此基础上指出研究方法的科学性是法学作为科学的基础,并评析了法学研究方法的3个维度,即实证维度、人文维度和形式维度。最后作者强调法学研究应坚持科学精神,反对科学主义。

| Abstract: | The disputes on whether law is a branch of science are actually related to the definition of science. On the basis of analyzing four types of law as a science, the authors point out that law as a science depends on its scientific nature of research methods, which contain three dimensions, namely positivist dimension, humanism dimension, and formalist dimension. Finally the authors emphasize that law research should stick to the spirit of science and fight against scientism. |
