| 摘 要： | 生态补偿作为一种经济手段已开始尝试运用于环境资源保护,但如何从法律上明确界定生态补偿的含义,界定生态补偿的主体与客体,设定生态补偿的监管体制,以及与现有的环境法律制度的衔接,尚有待进一步探讨。基于我国生态环境现状和经济社会可持续发展的要求,建立符合我国国情的生态补偿法律保障机制有其现实必要性和实施的可行性。当前,构建我国生态补偿法律保障机制应从以下几方面着手：征收环境资源税,扩展补偿资金来源;明确补偿标准和补偿方式。

| Abstract: | Ecological Compensation,as an economic measure,has been adopted to protect environmental resources.However,there still does not exist a legally clear and common understanding about the definition for eco-compensation as well as its subject and its object.In addition,how to establish an eco-compensation supervision mechanism that is consistent with the current environmental laws and legal institutions is also an exigent problem.In this thesis,based on a systematic review of the Developmental Course of Eco-compensation,an analysis about the necessity and feasibility of establishing Eco-compensation Legal Mechanism in China is conducted and suggestions such as imposing taxes on environmental resources,confirming the standard of eco-compensation that concerning this are proposed. |
