判例研究中新的视角及方法探求

引起广泛关注的＂同案不同判＂现象以及司法实务中法律统一解释适用方面存在的其他问题,都反映了必须加强判例研究并在方法上力求创新的时代要求。当前的相关研究中除了＂制度构建＂的思路外,还存在一种有新意的重要思路,即＂从司法实务中发现或提炼判例＂的研究路径。今后的判例研究应当整合这两种研究路径,使对于判例的研究本身成为有中国特色的判例制度建构过程之有机的一个部分。
