负面清单管理模式与法治经济

负面清单管理模式是我国深入外商投资管理改革的重要突破口,标志着我国深化市场准入制度改革的决心。对外商投资主体,负面清单奉行“法无禁止即可为”的法治理念; 对政府管理机构,负面清单则重申“法无授权即禁止”的义务推定。法治经济不仅要求在市场经济中发挥市场在资源配置中的决定性和基础性作用,而且要求政府在市场经济中必须依靠法治思维和方式进行经济管理和经济改革。负面清单管理模式既是法治经济精神的具体落实,也是法治经济精神的重要保障。

Negative listing management mode and legal economy

Negative listing management mode is an important breakthrough of deepening the management reform of foreign investment in China, which symbolizes the determination of deepening the reformation of market access regime in China. As for foreign investors, negative list pursues the philosophy of law of “no prohibition is free legally”; as for government agencies, negative list declares the obligations presumption of “what is not authorized by law is prohibited”.
