我国环境多元治理模式法律保障机制探究

未清晰地认识和定位政府、企业、社会公众三者的关系,未处理好三者的分工与衔接,是造成我国环境多元治理模式难以落实的关键问题。究其主要原因在于过分依赖传统政府管制模式的路径,以致政府在环境治理中起主导作用而轻视企业、社会公众作为治理主体的力量,导致其他治理主体参与环境治理法律机制的缺失。比较分析三者存在的障碍,提出落实环境多元治理模式法律保障的建议,从而构建起三者相互协作、共同治理环境的新局面。

Exploration of legal guarantee mechanism of environmental multiple governance mode in China

It’s the key problem of difficulty of carrying out the environmental multiple governance mode in China that the unclear understanding and positioning of the relationship among government, enterprise and the public, and the improper functional division and connection among them. The main reason of it lies in that the traditional governance relies so excessively on governmental control mode, that the government plays a dominant role in environmental governance and the power of enterprises and the public as governance subjects are belittled, which results in the lack of legal mechanisms of participation of other governance subjects in environmental governance. The existing barriers of them are compared and analyzed, and suggestions are proposed of realizing the legal guarantee of environmental multiple governance mode, in order to construct a new situation of collaborative and concerted environmental governance of them.
