| 摘 要： | 农村土地股份合作是我国土地产权制度创新的一种表现。当前出现了5种主要的土地改革模式，土地股份合作制取得了一定的成效。我国农地股份合作制度尚存在一些问题，从法律的视角出发，应明确土地股份合作组织的法律地位，明晰农地使用权的产权界定，调整土地方面的相关立法，完善治理结构和风险保障机制，制定扶持农地股份合作制发展的优惠政策。

| Abstract: | Joint-stock cooperative rural land property rights are a manifestation of institutional innovation, and the current major reform models have achieved some success. At the same time, the shares of Chinas agricultural cooperative systems still exist some questions. From the perspective of the law, cooperative organizations should be given a legal status the right to use agricultural land should be clarified, land-related legislation adjusted, governance structure and risk protection meehanisms improved, and preferential policies formulatedment. |
