量刑适用的内在与外在根据研究

量刑是沟通求刑与执刑的桥梁，是实现刑罚惩治犯罪、保障人权、恢复社会秩序的前提。为客观公正的适用量刑，必须加强对量刑适用正当性根据研究。社会危害性从客观方面和人身危险性从主观方面为量刑适用提供内在根据和基础；而刑事政策、法官情感、媒体舆论作为一种外在根据，同样对刑罚裁量发挥不可忽视的影响。

The Interior and External Bases of Sentencing Application

Sentencing is the bridge between prosecution and execution. It is the premise to the punishment of criminal offenses, to the protection of human rights and to the resumption of social order. Objective and fair application of sentencing owes greatly to the strengthened studies on the justness basis of sentencing application. Social harmfulness and personal dangerousness have provided the interior basis and foundation for sentencing application respectively from the objective and subjective aspects. Meanwhile, criminal policy, judiciary feelings and media opinion as external factors, play an important role in punishment measurement.
