论国际私法冲突规范之嬗变

国际私法主要研究的是如何解决法律冲突的问题,即法律适用或法律选择的问题。解决该问题的制度,就是国际私法中的冲突规范。自国际私法产生以来,发展出了各种各样关于冲突规范的学说。在19世纪以前,国际私法冲突规范学说是以"法则区别说"为核心的。19世纪,德国法学家萨维尼提出了"法律关系本座说"。冲突规范在经受了20世纪初期美国现实主义法学派学者的批判之后,自20世纪80年代以来,萨维尼的理论再一次受到重视,导致了冲突规则回归的潮流。冲突规范的发展变迁证明了其存在的必要性与不可替代性。
