| 摘 要： | 《侵权责任法》第2条正式确立了隐私权的独立地位,婚内知情权与隐私权作为独立的人格权利,两权不可避免存在冲突,冲突主要表现在婚外恋、私房钱、婚前情感、身体健康等方面,在协调两权冲突时,应当坚持宽容协调原则、人格尊严原则、法律效果和社会效果相统一等原则。

| Abstract: | The second clause of Tort Law formally establishes the independent status of the right of privacy.These two rights,the right to know and the right of privacy within marriage,as independent personality right,conflict inevitably.The conflict occurs mainly in the case of extramarital love,case-dough,pre-marital love,or physical health,etc.When coordinating this conflict,we should adhere to the principle of coordination and tolerance,human dignity,legal and social effects in unity. |
