| 摘 要： | 张康之教授在其近著《寻找公共行政的伦理视角》一书中,分析了权利在公、私领域存在的不同理由,创造性地提出了在公共领域拒绝权利这一主张,并提出以责任意识来代替权利意识的观点。但是作者提出的在公共领域拒绝权利这一观点是值得商榷的。我们可以通过职业定位、法律规制和提高道德责任意识等方面来合理规制行政人员的个人权利,使其无害于公共利益。

| Abstract: | Professor Zhangkang-zhi in his book public administration:A Moral Perspective,analyzes the different rights in pubic and private realm,puts forward the refuse right in the public realm,and he suggests to use duty consciousness to replace right.However this standpoint is worthy of discussion.We can use the position fixed,law rules system and enhance their moral duty consciousness to rule their personal right and make its harmless to public benefits. |
