| 摘 要： | 完整意义上的法制应该是常态法制与非常法制的结合。紧急状态法制是消除紧急状态的需要,更是克服法治危机的必需。紧急状态法律制度以权力(利)关系为核心范畴,构建起一个以宪法规范为最高层级的开放的法制体系。这一非常法制追求着不同层次的价值,以此为基础,形成了内涵丰富的紧急状态法制的基本原则。

Emergency Law:Another Type of Law |

| Abstract: | A complete legal system should consist of laws for normal times and those for times of crisis. Emergency law is required in times of crisis in order to manage and settle it. The emergency legal system is established within the framework of the relationships between power and interest; it is an open system which is governed by the constitution. This type of law is formulated to realize the values of a different level, which form the principles of emergency law. |
