论宋代皇权对司法的控制

宋代皇权对司法的控制非常严密。宋代皇帝掌握了死刑的判决和复核权，有权直接下诏并选派官员承审案件；亲自虑囚，裁决狱讼，并可使用御笔手诏，对案件直接作出最后裁决；还通过裁决有争论的重大案件、增加司法监督机构、严格选任司法官员等措施强化对司法活动的监督。这些措施对改变唐末五代司法的弊端具有积极意义。

On the Control of Emperor's Power to Judicatory in Song Dynasty

The control of emperor's power to judicatory is very tight in Song dynasty.Emperors have the right to verdict and recheck the death penalty.They also have rights to order and select officials to judge the case directly.Emperors still recheck jailbirds in person,verdict lawsuit and make final sentences by the imperial handwriting directly.Not only such,emperors of Song dynasty still enhance the supervision to judicial activities in meaning of deciding important cases which have controversy,increasing judicial organization,selecting judicial officials strictly.These measures have active meanings for improving irregularity in judicatory since later Tang and the Five dynasty.
