外贸法修订案介评

文章对外贸法修订案从经营者、经营权的取得方式、国营贸易、自动进出口许可、限制和禁止进出口、与外贸有关的知识产权保护、对外贸易调查和对外贸易救济、法律责任等方面进行了逐个介评.在此基础上,指出修订案存在着法律定位准确、原则性和操作性并存、个别法律制度缺失的特点.

Introduction and Evaluation of the Revised Foreign Trade Law

The paper make a successive introduction and evaluation of the revised foreign trade law from the business manager, the acquisition of the managerial authority, state-run trade, automatic export/import permit, restriction and prohibition to the protection of intellectual property right concerning foreign trade, investigation and relief of foreign trade and legal liabilities. It further points out its characteristics of accuracy of legal positioning, co-existence of principle and workability and missing of some legal systems.
