著作人身权问题探疑——为促进著作财产权交易

在关于著作人身权妨碍著作财产权交易问题的讨论中,主张摒弃著作人身权制度的取消说和主张著作人身权进入商业流通的转让说虽不无可取之论,但因其主体论说无法自圆其说而不能解决问题.著作人身权虽与主体之间具有一定的可分离性,但这与著作财产权的可完全分离性有着本质上的不同;著作人身权进入商业流转有悖设权初衷,等于变相取消了著作人身权.应从现实国情出发,借鉴英、法等发达国家创设与改革著作人身权制度的有益经验,从而探寻重构著作人身权制度的路径.建议我国著作权立法在规定著作人身权不可以转让但允许适当放弃的同时,对著作人身权作出必要的限制,以利于著作财产权交易,促进文化产业发展.

Exploring the problem of writer's personal right:To promote the trading of property rights

In the discussion of the question about copyright-related personal rights hinders the property rights trading,although the proposition of abandoning the abolition of copyright-related personal rights system is not altogether unacceptable,it cannot solve the problem because its main argument cannot be right its cause. Although the copyright-related personal rights has a certain separability with the main body,it is fundamentally different from the completely separability of the property right in work;the copyright-related personal right into the commercial circulation has the original intention of default right,which is equal to cancel the copyright-related personal rights in disguised form.It should start from the actual national situation,and learn from the useful experience that the developed countries like the United Kingdoms and France created and reformed copyright-related personal rights,so as to explore the way to reconstruct the copyright-related personal right system.This paper suggests that when China's copyright legislation regulates that copyright-related personal rights cannot be transferred but allowed to give up properly,it should make some necessary restrictions on copyright-related personal rights,so as to facilitate the transactions of property right in work and promote the development of cultural industries.
